CONTRACTUAL BASES FOR YOUR HOTEL RESERVATION
General Terms of Business (hereinafter called “terms”) for booking a hotel and/or wellness offer online.
Dear visitor,
Please pay attention to the following terms of booking. They cover the legal relationships between you and Wellness-Hotels & Resorts GmbH (hereinafter called “WH-R”). These terms of booking become a part of the contract concluded with WH-R as an agent for hotel accommodation as well as wellness services.
1. Scope
The following terms apply to your bookings via the WH-R system. This covers individual bookings of one to three rooms as well as various wellness services offered on our websites.
Each booking is forwarded to the hotel concerned by WH-R on your behalf as a messenger. These bookings are binding for both you and the hotel.
WH-R facilitates the booking of overnight accommodation and wellness services via an electronic booking system. In the scope of this activity, WH-R does not render any own accommodation or wellness services; On the contrary, it facilitates them on behalf of and for the account of third party businesses, the service providers.
2. Accommodation contract and payment
The accommodation contract is concluded directly between you and the hotel you have chosen on booking via WH-R. The price confirmed by W-H-R is to be paid directly at the hotel or, if the hotel requests and states such, at the time of booking (advance payment).
All claims and obligations resulting from the accommodation contract exist directly between you as the party booking and the hotel as the hotel you have chosen. WH-R is not liable at any time for services rendered or not rendered by the hotel.
The booking is also valid without a confirmation of booking. The confirmation of booking is displayed on the screen after completion of the booking and can be printed out. It will also be sent to you as customer by email as brief information. WH-R cannot assume any liability for the receipt of the confirmation by email or other media. The validity of the booking shall remain unaffected.
3. Alterations and cancellations
The conditions for alterations to and cancellations of bookings made are stipulated by the hotels individually. As a guest, it goes without saying that you will be advised of these conditions prior to completing the booking process.
If the hotel, for example, permits a free cancellation of the accommodation contract by 6 p.m. local time on the day of arrival, then your booking will be maintained in principle until 6 p.m. local time (standard booking). In the case of non-arrival by 6 p.m. local time, your booking will be cancelled by the hotel free of charge. You then no longer have a claim to accommodation.
In order to avoid misunderstandings, all cancellations must be made via the WH-R booking system. Cancellations made directly with the hotel have, in case of doubt, no releasing effect. The same applies to alterations, insofar as they can be made via the booking system.
4. Cancellation by WH-R
In order to prevent the misuse of our free booking system, and to protect the hotels from wrong bookings, WH-R reserves the right to cancel a booking in individual cases if it is not possible for WH-R to make an enquiry under the telephone number or email address stated by the guest.
The same applies if bookings were frequently made in the past stating the email address stated by the guest where the guest did not show up or where an enquiry made by WH-R was without success.
Furthermore, WH-R reserves the right to verify the validity of the credit card details stated by the party booking. In the event of receiving negative information pertaining to the credit card details, WH-R reserves the right to cancel the booking on their part, without the party booking obtaining a claim to compensation. In the cases stated, the booking party has no claim to accommodation.
5. Service prices agreed per contract
All prices displayed in our booking system are room, wellness or arrangement prices the hotel owners have entered into the WH-R system and are thus guaranteed by the hotel. They are valid for all individual bookings made via WH-R.
All prices are per room, per night, per wellness offer and/or arrangement. The room prices are partly including and partly excluding breakfast. For Germany, the prices include the service charge and the respectively applicable value added tax. Should value added tax change between the date of booking and the stay at the hotel, the value added tax that is then valid shall apply to the booking. A local and usual spa tax and/or other charge may be levied, which, where the case may be, is incurred in addition to the amount stated by WH-R.
All additional services the party booking makes use of (e.g. hotel restaurant, telephone, Internet access, exercise equipment) will be invoiced by the hotel separately and are only included in the total price if this is stated in the terms of the hotel.
6. Data policy
The data entered by the party booking are disclosed by WH-R to the extent necessary for the processing of the booking. It shall not be disclosed for any other purposes. When collecting data, the statutory privacy policy applicable in Germany shall be observed. For bookings by guests from outside Germany, the data policy of the Federal Republic of Germany shall also apply.
7. Miscellaneous
All information was compiled with the greatest of care. WH-R cannot assume any liability for possible errors when collecting or transmitting data.
The storage of data in other data carriers, also in part, or the use of the same for purposes other than those intended here is only permitted upon express consent by WH-R Düsseldorf. German law applies. Court of jurisdiction, insofar as legally possible, is Düsseldorf.
